Daniel Penny, a 25-year-old Marine veteran, faces felony charges for allegedly using a chokehold on a homeless man which resulted in the man’s death.
Joseph Caballer, a combat Marine instructor, testified that while a chokehold can incapacitate, it must be released immediately once the person is unconscious.
Prosecutors argue that Penny acted with indifference toward Neely's life, holding the chokehold for nearly six minutes even after he stopped resisting.
During the trial, Penny’s defense highlights Neely’s history of mental illness and struggles, portraying him as a threat before the chokehold was applied.
