Big Ass Fans has faced penalties totaling $450,000 for misleading advertisements regarding their air purifying devices, specifically from claims that their fans could eliminate 99.99% of the COVID-19 virus. A settlement with California district attorneys requires the company to pay restitution, mostly to affected customers. Critics, including air quality experts, argue that the claims were based on limited testing conditions that do not apply to real-world settings, casting doubt on the actual effectiveness of the products they marketed.
"There's no other way to say it - it's completely unproven whether these devices would work in a real-world setting," Timothy Bertram, a chemistry professor at the University of Wisconsin-Madison, told Kaiser Health News in 2021.
Prosecutors determined there was insufficient support for the company's advertising claims, and that the advertised efficacy rates were not achievable in real-world scenarios.
