Ex-MPP's convoy case back on after stay of charges overturned | CBC News
"The Court of Appeal for Ontario found that Superior Court Justice Kerry McVey should have attributed another 93 days of delay to exceptional circumstances, allowing the case to remain within the designated limits."
"The Appeal Court noted that some delay was inevitable because there was nothing the Crown could have done to obtain an immediate date for the 'rehearing' of the change of venue application."
"Prosecutors made efforts to address the delay and accepted one of the earliest dates offered by the court, indicating a commitment to moving the case forward."
The Ontario Court of Appeal has reinstated charges against Randy Hillier, a former politician, after overturning a lower court's decision to stay the case. The lower court had ruled that the case exceeded the Supreme Court's 30-month limit. However, the Appeal Court determined that an additional 93 days of delay should be attributed to exceptional circumstances, bringing the case back within the time limits. The case will now return to Superior Court for further proceedings.
