Edwin Velasquez Munoz, a 31-year-old Peruvian asylum-seeker with developmental and auditory disabilities, was detained by ICE for over a week after a court hearing. While in transit, he had no contact with his attorneys or family. After numerous requests, his location was confirmed at the Metropolitan Detention Center in Brooklyn. Velasquez entered the U.S. in March 2024 and has an active asylum application. His attorneys at NYLAG expressed concerns about his disabilities impacting his understanding of the situation.
Melissa Lim Chua, a senior staff attorney at NYLAG, stated that Edwin Velasquez Munoz was detained after attending an immigration court hearing, despite complying with legal requirements.
Chua described the experience of his family and attorneys, mentioning, "We were told for over a week he was in transit... we had to wait until he was somewhere permanent before we could speak to him."
Chua emphasized, "Velasquez Munoz entered the U.S. in March 2024, has an active asylum application, and has complied with all legal requirements," which raises concerns about his detention.
NYLAG expressed concern over Velasquez's disabilities and the possible lack of understanding regarding his situation, highlighting that he needs special support to communicate effectively.
