Travis County District Judge Jessica Mangrum has ruled that the city of Austin must pay $175,000 in attorneys' fees for failing to abide by a previous order requiring notice to property owners when changing development rules.
The order to draw up the required order includes provisions for additional fees if the city chooses to appeal, escalating based on the appellate steps taken, and payable only if the plaintiffs prevail.
Plaintiffs in the case successfully challenged three ordinances aimed at creating more housing, including affordable housing, leading to rejection. City Council has since passed a new version of the vertical mixed-use ordinance to allow housing in commercial properties.
