After nearly two hours of argument, a judge agreed the issue was moot under New Jersey criminal law, upholding all charges against the driver, including manslaughter.

"We are always encouraging people to be out and about and active and then this awful tragedy happened. I passed the scene earlier and there are a lot of flowers and balloons where people have been trying to come together to show their support for the family. It's hard to comprehend it all," he added. "No parent should ever have to have a funeral for a child," he said.
