What will happen with the Equal Rights Amendment under Trump?
Briefly

Former President Biden has declared the Equal Rights Amendment (ERA) as the 'law of the land,' prompting advocates to call for its celebration and implementation. The American Bar Association has affirmed the amendment's ratification under the Constitution, urging government sectors to uphold it. However, skepticism remains regarding its original ratification timeline, with calls for a renewed proposal if it faces legal challenges. Despite these doubts, advocates continue to push for reviewing laws to align with the ERA and cite it in discrimination cases.
"Now that Biden acknowledged the ERA, the next steps are celebration and implementation," says Kati Hornung, cofounder and executive director of VoteEquality!, a nonpartisan group promoting equal rights for all.
The American Bar Association passed a resolution in October 2024 affirming the 28th Amendment achieved every requirement for ratification under Article V of the Constitution.
