"The issue emerged at the height of Trump's attack on LA, when multiple citizens reported that ICE was rounding up anybody who was Latino, or looked Latino, for questioning. Racial profiling is unconstitutional (or was, until this morning) and people sued, including the named plaintiff in this case, Pedro Vasquez Perdomo. District Court Judge Maame E. Frimpong (a Biden appointee) issued an emergency injunction prohibiting the raids in July,"

On Monday the Supreme Court issued a temporary order allowing ICE to resume racially profiling Latinos in Los Angeles pending review of the full record. The temporary lift followed a 6-3, party-line vote in which conservative justices signaled willingness to uphold the practice on the merits; Justice Brett Kavanaugh provided the only Republican majority explanation. The case, Noem v. Perdomo, reached the shadow docket after reports that ICE was rounding up anyone who was Latino or appeared Latino. District Court Judge Maame E. Frimpong issued an emergency injunction in July, and the government appealed. The government admitted reliance on four factors: apparent race or ethnicity; speaking Spanish or English with an accent; location type; and apparent job type.
