The Supreme Court ruled 6-3 that the International Emergency Economic Powers Act (IEEPA) does not authorize the president to impose tariffs. Chief Justice John Roberts wrote that the president claimed extraordinary unilateral tariff power and that Congress never indicated IEEPA applied to tariffs. Justices Neil Gorsuch and Amy Coney Barrett joined the majority alongside the three liberal justices. President Trump used IEEPA in 2025 to impose reciprocal tariffs affecting countries including China and Canada. The tariffs contributed to Nintendo delaying Switch 2 pre-orders and spurred price increases across consoles and accessories. The decision is a legal setback, but the president may pursue other legal methods to reinstate tariffs.
