The former SpaceX engineers have argued that the private space company did not belong under the NMB's jurisdiction because SpaceX only offers services to "hand-picked customers." In an opinion, however, the NMB stated that SpaceX was under its jurisdiction because "space transport includes air travel" to get to outer space."
