Paid COVID leave requirements will end on July 31, 2025, after being mandatory since 2020. New York City and New York State have laws that require employers to provide paid sick leave, with varying hours based on the size of the workforce. Employers with 100 or more employees must provide up to 56 hours, while those with 5 to 99 employees must provide 40 hours. Smaller businesses may have different obligations depending on income. Additionally, crime victims and subpoenaed witnesses are entitled to unpaid leave for testimony.
Since 2020 all employers have been required to provide paid COVID leave on top of all other leave required by law. That included up to two weeks depending upon the business size, and additional time for vaccination.
Employers with 100 or more employees must provide up to 56 hours of paid sick leave; those with 5-99 employees must provide 40 hours, and employers with fewer than five employees may provide 40 hours unpaid unless certain conditions are met.
