A nonprofit, Democracy Forward, filed a lawsuit against the Office of Personnel Management, the General Services Administration, the Department of Housing and Urban Development, and the Office of Management and Budget for failing to respond to FOIA requests about AI use. The FOIA sought information on agencies' use of AI systems to analyze public comments and implement policy, including tools used by OPM in reviewing responses to the proposed rule "Improving Performance, Accountability and Responsiveness in the Civil Service." Democracy Forward submitted additional FOIAs seeking inputs and outputs of OPM AI tools and asked how GSA, HUD, and OMB leverage AI in policy implementation. The nonprofit cited concerns about unreliable AI expanding efforts to weaken protective regulations and said agencies must be accountable; the agencies must respond to the lawsuit within 30 days.
