Barrett had called the police to assist Marshall during a mental health crisis, but a crisis intervention team did not respond. Officers arrived and engaged Marshall, who was reportedly carrying a BB rifle and a crowbar. After firing beanbag rounds at him, officers switched to lethal force when he lunged at them, continuing to use force even after he was mortally wounded.
Nine months after the confrontation that led to her son's death, Ellen Barrett sued the City of Carmel and involved police officers, alleging excessive force during the incident.
Barrett called for police assistance during her son's mental health crisis, aware of his bipolar disorder. Officers failed to deploy a crisis intervention team that had previously succeeded with Marshall.
Marshall was reported to be wielding a BB rifle and a crowbar that morning. When police arrived, an officer fired beanbag rounds, ultimately leading to lethal gunfire.
Despite Marshall being mortally wounded, officers continued to use beanbag rounds and tasers on him as he advanced toward them, according to statements in Barrett's lawsuit.
