The case against Garcia began with a traffic stop. He was driving a vehicle with nine passengers, and police suspected human smuggling. Despite suspicions, he was permitted to continue driving.
US officials are attempting to deport Garcia to a country other than El Salvador, citing concerns about him being a community danger. The deportation procedure is feared to coincide with his trial date in January.
Garcia's wrongful removal from the U.S. in March violated a judge's order that protected him from deportation due to threats of gang violence should he return to El Salvador.
