AI capabilities now permit easy creation and alteration of images and videos, enabling realistic deepfakes that can convincingly misrepresent people. Deepfakes can be nearly indistinguishable from authentic media and can cause deception, harm, and criminal conduct, particularly involving sexual content or minors. New York expanded criminal liability to expressly criminalize creation and dissemination of nonconsensual sexually explicit deepfakes. The law was amended to cover images created or altered by digitization and to clarify that an original intimate photo is not required; an AI-created image that reasonably identifies a person falls within statutory protection.
