More than three dozen Democratic and independent senators asked DHS Secretary Kristi Noem to clarify the agency's position on DACA beneficiaries and their protection from deportation. DHS issued a statement saying illegal aliens who claim DACA are not automatically protected from deportation and that DACA does not confer legal status, and a DHS spokesperson encouraged self-deportation. Senators cited DHS guidance stating those with deferred action are not considered unlawfully present and are authorized to be in the United States for the duration of deferred action. DACA was created in 2012, covers about 500,000 people, requires renewal every two years, and does not provide an immediate path to citizenship.
