"Armed soldiers should not be policing American citizens on American soil. The forced military occupation of the District of Columbia violates our local autonomy and basic freedoms. It must end, D.C. Attorney General Brian Schwalb wrote on X on Thursday. DC did not request or consent to the deployment of National Guard troops. Yet there are 2,300 National Guardsmen on our streets in military gear, carrying weapons, and driving armored vehicles. Their deployment to DC violates the Home Rule Act enacted by Congress 52 years ago."
"The Posse Comitatus Act prohibits the military from engaging in domestic policing. Yet the Administration launched a massive, indefinite law enforcement operation in DC under direct military command. This is plainly illegal, and it threatens our democracy and civil liberties, he wrote."
"Schwalb called the National Guard deployment an involuntary military occupation by the administration. Our nation was founded on the fundamental principles of freedom and self-governance that are stake in this case. No city in America should be subject to involuntary military occupation, he wrote. We are suing to defend DC home rule and stop the unlawful deployment of the National Guard."
The District of Columbia filed suit against the federal administration over the deployment of National Guard troops to Washington, D.C., alleging an involuntary military occupation. D.C. did not request or consent to the deployment and reports 2,300 National Guardsmen in military gear, armed and operating armored vehicles on its streets. The deployment is alleged to violate the Home Rule Act and the Posse Comitatus Act by placing military command over domestic policing. The Attorney General calls the operation plainly illegal and a threat to democracy and civil liberties and seeks to end the deployment and defend D.C. home rule.
