Amy Coney Barrett Defends Overturning Roe v. Wade to CBS
"Barrett joined the majority in voting 6-3 to overturn the nearly 50-year precedent. The Supreme Court's decision in Dobbs gave that decision to the democratic process and to the states, Barrett said. It didn't roll back rights. It didn't render abortion illegal, unconstitutional, or anything else. And in effect, many states very fully protected abortion rights, more than under the regime of Roe since the time of the decision in Dobbs."
"O'Donnell asked about the Dobbs decision from 2022, which overturned the longstanding Roe v. Wade guaranteeing women the right to abortion in all 50 states. O'Donnell challenged Barrett, saying, But it rolled back a federal right to abortion. A constitutional right to an abortion. Well, what it said is that the Constitution had not protected the abortion right under the Due Process Clause. And it said that Roe had been an error and Casey had been an error to hold otherwise, Barrett said."
The Dobbs decision in 2022 overturned Roe v. Wade, removing federal constitutional protection for abortion and returning authority over abortion regulation to states and the democratic process. The decision concluded that the Due Process Clause did not protect an abortion right and characterized Roe and Casey as erroneous. Many states have subsequently enacted varying levels of protection, with some enhancing abortion access beyond prior Roe-era protections. The decision prompted security measures, including obtaining a bulletproof vest and the need to explain developments to children. A portrait of Abigail Adams in a judicial office was cited as reflecting the compatibility of motherhood and judicial service.
