The Federal Trade Commission voted 3-1 to dismiss its appeal and take steps to vacate a finalized 2024 rule banning noncompete agreements. The 2024 ban had never taken effect after a Texas federal judge found the FTC likely exceeded its authority and halted the rule nationwide following a lawsuit by Ryan LLC. The Biden administration appealed to the 5th Circuit, but the subsequent administration requested pauses in the appeal while the new FTC leadership reconsidered defending the rule. Republican commissioners called the rule illegal and preemptive, while one Democratic commissioner dissented after returning to the commission seat.
