A recent filing by Solicitor General John Sauer claims that the Department of Government Efficiency (DOGE) is merely an advisory group, contradicting President Trump’s prior statements about Elon Musk's leadership. This has raised legal questions following multiple lawsuits targeting DOGE's activities, particularly in light of Musk’s public persona versus the secretive nature of Amy Gleason's appointment as the Acting Administrator. The Supreme Court application aims to block records requests, highlighting a significant retreat from Musk's earlier promise of transparency and putting DOGE’s role under scrutiny.
In the 35-page legal memorandum, Sauer argued that DOGE is merely an advisory group and not an actual federal agency, and therefore should be exempt from having to produce public records under the Freedom of Information Act.
Trump himself has added to the confusion regarding Musk's actual role, saying back in February that he signed an order creating DOGE and put a man named Elon Musk in charge.
