A Fox Sports hairstylist who accused Skip Bayless of unwanted sexual advances tried to dismiss her Los Angeles Superior Court lawsuit but the court rebuffed the request. The complaint names Skip Bayless, Fox Corp., commentator Joy Taylor and executive Charlie Dixon as defendants. The lawsuit alleges sexual battery, retaliation and wrongful termination and also includes a class-action claim alleging failure to pay minimum wages, reimburse business expenses and pay severance for other employees. The court requires either refiling without the class claim or an explanation for dismissing the individual complaint while the class action continues.

"The judge sits in an advisory, almost fiduciary relationship with those who stand to benefit from the class action," Wheeler said. "If the case was settled to the single plaintiff, the judge might say, 'Hold on, what's the deal with the class action?' Judges do not want plaintiffs using the threat of class action to extract a better settlement.'"
