The judge, Paula Xinis, expressed dissatisfaction with the government's compliance efforts and emphasized the urgency of Garcia's return after a Supreme Court ruling upheld her initial order. The administration requested time to analyze the ruling, creating tension in court as Xinis pressed for immediate clarity on Garcia's location and the government's actions taken so far to facilitate his return.
"I'm not asking for state secrets. He's not here. The government was prohibited from sending him to El Salvador. And now I'm asking just a very simple question. Where is he?"
"Foreign affairs cannot operate on judicial timelines, in part because it involves sensitive country-specific considerations wholly inappropriate for judicial review," the lawyers wrote.
"We intend to comply with Supreme Court's order," Ensign told the judge. "We're actively taking steps to do so. We are not able to meet the court's expectations yet."
