His defense counsel have already asked the judge for a determination if their client is mentally fit to stand trial, according to ABC News. On Wednesday, a federal grand jury returned an indictment against Brown, charging him with violence against a railroad carrier and mass transportation system resulting in death."
Decarlos Brown Jr., 34, has been federally indicted for violence against a railroad carrier and a mass transportation system resulting in death. The indictment follows the August 22 stabbing death of 23-year-old Ukrainian refugee Iryna Zarutska on a Charlotte light rail train, captured on surveillance video. Brown was arrested on the train platform and also faces a state first-degree murder charge in North Carolina. The federal and state charges carry possible life imprisonment or the death penalty upon conviction. Defense counsel have requested a judicial determination of Brown’s mental fitness to stand trial. A state hearing was postponed to April 2026. Assistant U.S. Attorney Mark Odulio is prosecuting the federal case.
