Judge rules immigration detention of Chicago man with daughter battling cancer is illegal
"CHICAGO (AP) The detention by immigration authorities of a Chicago man whose 16-year-old daughter is undergoing treatment for advanced cancer is illegal, and he must be given a bond hearing by Oct. 31, a federal judge has ruled. Attorneys for Ruben Torres Maldonado, 40, who was detained Oct. 18, have petitioned for his release as his deportation case goes through the system."
"My dad, like many other fathers, is a hard-working person who wakes up early in the morning and goes to work without complaining, thinking about his family, Ofelia said in a video posted on a GoFundMe page set up for her family. I find it so unfair that hardworking immigrant families are being targeted just because they were not born here."
Ruben Torres Maldonado's detention by immigration authorities was found illegal and a violation of due process, and a bond hearing must be held by Oct. 31. The court declined to order immediate release, noting sympathy for the detainee's 16‑year‑old daughter's advanced cancer but emphasizing statutory, procedural, and precedent constraints. Torres' lawyers have petitioned for his release while his deportation case proceeds, and they plan to seek bond in immigration court as he pursues permanent residency. Torres was detained at a suburban Home Depot; his daughter, Ofelia, is undergoing chemotherapy and radiation for metastatic alveolar rhabdomyosarcoma. The children are U.S. citizens.
