The 1st U.S. Circuit Court of Appeals in Boston ruled that the Trump administration cannot withhold citizenship from children born in the United States to parents who are in the country illegally or temporarily. A three-judge panel upheld lower courts' preliminary injunctions that block the president's birthright order while multiple lawsuits proceed. The panel concluded plaintiffs are likely to succeed on claims that the children described in the order are entitled to birthright citizenship under the Citizenship Clause of the Fourteenth Amendment. The order would have halted automatic citizenship for babies born to people in the U.S. illegally or temporarily. Nearly 20 states participated in the legal challenge.
