Brookline family sues over death of 'matriarch' in crosswalk
"The impact left [Mendez] in critical condition with multiple skull fractures, rib fractures, a shattered ankle, a massive brain bleed and traumatic brain injury. She was immediately rushed to the hospital and underwent emergency brain surgery,"
"negligently failed to keep a proper lookout for [Mendez] as she attempted to take a right turn from Hammond Street onto Boylston Street, crashing the Massachusetts State Police cruiser into Mendez."
"renews our deepest condolences to the family and loved ones of Ms. Mendez"
Margie Mendez, an 86-year-old Brookline resident, was struck in a Route 9 crosswalk in Chestnut Hill on Jan. 15 by a Massachusetts State Police cruiser driven by Trooper Kyle Santoro. She sustained multiple skull fractures, rib fractures, a shattered ankle, a massive brain bleed and traumatic brain injury, underwent emergency brain surgery, spent months hospitalized, and died on April 5; her death certificate attributes death to injuries from the crash. Mendez’s family filed a negligence and wrongful death lawsuit alleging the trooper failed to keep a proper lookout while turning. The Norfolk District Attorney investigation found the trooper not at fault. State Police offered condolences and declined to comment on pending litigation.
