Eleanor Donaldson was found unfit to stand trial on historic sex-offence allegations. A judge, after considering evidence from a consultant forensic psychiatrist and additional medical reports, concluded she could not properly participate in the trial process. The psychiatrist stated she would be unable to instruct her lawyers, follow proceedings, or give evidence due to her mental condition. Eleanor Donaldson faces charges of aiding and abetting, which she denies. The scheduled trial begins with jury selection, but Eleanor’s case will proceed as a trial of the facts. A jury will decide whether the alleged acts were committed, and the outcome cannot result in a criminal conviction. Legal submissions were heard on whether the trial of the facts should run alongside Jeffrey Donaldson’s trial or separately.
"Dr Kennedy told the hearing at Newry Crown Court she had prepared two reports on Eleanor Donaldson last October and May this year. She said in her opinion, given her mental condition, she would be unable to instruct her lawyers, follow the process or give evidence."
"Judge Ramsey said he was satisfied on the evidence that Eleanor Donaldson was not fit to stand trial. Eleanor Donaldson will now be subject to a trial of the facts. A jury will determine whether she committed the alleged acts but the process cannot result in a criminal conviction."
"The judge heard further legal submissions during Wednesday's hearing on whether that trial of the facts should run alongside the trial of Jeffrey Donaldson or as separate proceedings at a different time. He is due to rule on that point on Thursday. Neither Jeffrey or Eleanor Donaldson were present in court for the ruling. They were not required to attend."
"Jeffrey Donaldson has pleaded not guilty to 18 alleged offences, including one count of rape, as well as allegations of indecent assault and gross indecency. The alleged offences span a time period between 1985 and 2008, and there are two alleged victims."
