Appeal lodged against High Court ruling on trans access at Hampstead Heath swimming ponds
"In my view the more appropriate person to bring this claim is an individual who says that they have been discriminated against by decisions about access to the ponds."
"Kenwood Ladies' Pond is an iconic battleground for campaigners for women's sex-based rights. A judgement in this case would provide a template for other single-sex services, and show that service providers cannot get away with ignoring the law."
Sex Matters will appeal Mrs Justice Lieven's ruling that the charity could not bring a High Court legal action against the City of London Corporation. The charity challenges a City policy allowing trans people into single-sex facilities based on the gender with which they identify, arguing that allowing trans people into those spaces amounts to sex discrimination. The legal challenge followed a Supreme Court ruling that a person's sex refers to their biological sex. The charity raised more than 65,000 to fund its challenge but the High Court judge said the county court and an individual claimant would be the more appropriate forum. Sex Matters has applied for permission to challenge the ruling at the Court of Appeal, while the City argued the claim should be dismissed as out of time because the policy has been in place.
