"Ontario's police watchdog says it is not investigating the case of a lawyer who is alleging that multiple Durham Regional Police Service officers slammed her head on a desk without provocation and dragged her to the basement cells of the Oshawa courthouse last week. In response to questions from CBC News, Special Investigations Unit (SIU) spokesperson Kristy Denette said that Durham police notified the SIU about the incident involving defence lawyer Sudine Riley on Tuesday, but the agency has not invoked its mandate"
"The SIU's investigative jurisdiction is limited to those incidents involving officials where there is a serious injury, death, allegation of sexual assault or discharge of a firearm by an official at a person, Denette said. According to the SIU's website, the agency considers an injury to be serious if it is likely to interfere with the person's health or comfort and is not transient or trifling in nature."
The SIU was notified about an incident in which a defence lawyer alleges multiple Durham Regional Police officers slammed her head on a desk and dragged her to basement cells at the Oshawa courthouse. The SIU has not invoked its mandate because its jurisdiction covers serious injury, death, allegations of sexual assault, or discharge of a firearm by an official. The SIU defines serious injury as one likely to interfere with health or comfort and not transient or trifling, and provides examples such as hospital admission and fractures. Durham police say they are working with court services to obtain and review all evidence. Multiple legal agencies have condemned the alleged attack and called for an independent investigation. The lawyer, represented by Neha Chugh, described officers putting their knees on her back and neck and speaking with rage, disrespect, and contempt.
