In a landmark 121-page decision, the Ontario Court of Appeal upheld a ruling that the popular Sauble Beach strip belongs to the Chippewas of Saugeen First Nation, reinforcing historical treaty rights.
Justice Vella's ruling articulated that the Crown breached treaty rights by failing to protect the land as outlined in Treaty 72. She emphasized that no third parties have any legal claim on Chi-Cmiinh.
The court confirmed that the federal government inherited responsibilities regarding the protection of these lands upon Confederation in 1867, reaffirming the Chippewas of Saugeen's ownership of the beach.
Despite disappointment from local officials regarding the decision, they expressed respect for the judicial process and a commitment to consider the implications for their community going forward.
