Section 230 of the Communications Decency Act has become a controversial issue among lawmakers since its creation in 1996, with bipartisan efforts emerging to repeal it due to frustrations over Big Tech's accountability. Critics assert that the provision allows tech platforms to avoid removing harmful content. However, many experts argue that repealing it outright, without a structured plan for reform, could lead to unintended consequences, indicating that current criticisms may lack depth and requiring more serious solutions to manage online content responsibly.
"Sunsetting Section 230 without proposing ways to change it is like taking a hostage without having a list of demands ready," says Adam Kovacevich, founder and CEO of the Chamber of Progress, a tech industry trade group.
Since its passage in 1996, it has fueled frustration across the political spectrum, with critics arguing that it enables Big Tech to dodge accountability.
