The town disagrees with the state’s interpretation that allows developers more than one 90-day period to submit builder's remedy applications, arguing that only one should be allowed. This legal action could impact 12 pending applications, including two major developments. Mayor Hudes insists that clear timelines are essential for housing production, warning that vague rules may cause further delays in needed residential development.
"An unlimited length of time for an application to be open allows for property development to be delayed an infinite amount of time. Without moving through a process where there are timelines essentially doesn't produce housing at all."
"The legal action could affect some of the town's 12 pending builder's remedy applications, including the controversial 175 homes proposed for The Arya development at the Ace Hardware site."
