The county attorney emphasized that the adopted removal procedures do not allow overruling the sheriff's objection to an open hearing. The hearing is scheduled for August 18-29, following a Board of Supervisors vote to remove Corpus, which was granted by voters through Measure A. The First Amendment Coalition has warned that closure would violate First Amendment rights and threaten legal repercussions for the county.
The county agrees that the Removal Hearing provided for under Section 415.2 of the County Charter and the Removal Procedures should be open to the public, County Attorney John Nibbelin stated.
If closure occurs as Sheriff Corpus has requested, it would violate the First Amendment right of access to public proceedings, as warned by the First Amendment Coalition.
The hearing is expected to take place from August 18-29, following the Board of Supervisors' vote in June to remove Sheriff Corpus, which was authorized by Measure A.
The County Attorney's Office will not oppose any lawsuit filed regarding the hearing's public nature.
