A new court-ordered injunction in San Jose prohibits seven suspected drug dealers from loitering near St. James Park. The court granted this injunction as part of a city lawsuit targeting individuals with arrest histories for drug-related offenses. Mayor Matt Mahan suggested the approach could extend to other areas identified as hotspots for addiction and homelessness. Concerns regarding due process have been raised, particularly by the NAACP of San Jose/Silicon Valley, which argues the strategy could lead to discrimination without proper legal processes for determining guilt or innocence.
The city's lawsuit sought the injunction against 10 people, and Superior Court Judge Roberta Hayashi only granted it for seven in late April.
If found loitering within 100 yards of St. James Park, the defendants would be arrested, according to the mayor's office.
City Attorney Nora Frimann stated that her office didn't track whether these people were convicted of crimes and focused solely on arrest history.
The NAACP of San Jose/Silicon Valley expressed concern that the injunction strategy lacks proper due process and can be discriminatory.
