New S.F. planning director's appointment process was illegal, commissioner says

Kathrin Moore, the vice president of the San Francisco Planning Commission, is calling into question the legality of Mayor Daniel Lurie's recent appointment of Sarah Dennis Phillips as planning director. Moore claims that commission president Lydia So violated the Brown Act by discussing and influencing the appointment with a majority of commissioners ahead of a vote. Attorney Jim Wheaton emphasized that such discussions outside of official meetings breach the law. The city attorney's office declined to comment on the situation, citing privileged communication.
"Deliberation outside of the meeting with the majority of the members - that alone is a violation of the Brown Act. Period," said attorney Jim Wheaton.
"We cannot comment on this. Any potential legal advice and analysis on this topic would be privileged attorney-client communication," city attorney's spokesperson Alex Barrett-Shorter wrote.
