The family of Johnny Peterson filed a wrongful death lawsuit against Impact Plastics, alleging the company forced workers to remain on-site despite known dangers from Hurricane Helene.
Many surviving employees report they were not allowed to leave the factory in time to avoid the flooding, indicating a severe breach of employee safety protocols.
The lawsuit alleges that Impact Plastics lacked any evacuation plan, which played a crucial role in the tragedy as employees requested permission to leave but were denied.
According to attorney Alex Little, 'Based on information we've uncovered... we believe this tragedy could have been avoided,' suggesting negligence on the part of the company.
