Judge Douglas L. Rayes overseeing the U.S. District Court case granted the motion by plaintiff John Masiello and Realty ONE Group to dismiss the lawsuit.
The dismissal comes as a result of Realty ONE Group's settlement in the Gibson suit, which was granted final approval in late October and eliminates actionable claims.
The Masiello lawsuit is one of around two dozen copycat commission lawsuits that emerged after the jury verdict in the Sitzer/Burnett case.
Realty ONE Group's proposed settlement, announced in April 2024, signifies a successful resolution and dismissal from potential future litigation involving commission lawsuits.
