The decision of a delegate of the information commissioner, who holds responsibility for enforcing the Privacy Act, was revealed this month in a federal court of appeal ruling that rejected an appeal against the decision.
Madzikanda claimed his employer could only have known about his personal projects and contacting rivals by reading the contents of his personal emails and accessing his iCloud account.
The company denied using personal information to make their decision.
