Priced Out of Affordable Housing: City Sides With Property Owner in Dispute Over Rents

In December last year, tenants at the Everett Station Lofts approached the Portland Housing Bureau (PHB) with a demand letter regarding overcharging on rents. They alleged that the owners miscalculated affordable units' rents based on square footage rather than bedrooms, violating local housing laws. Although PHB initially supported the tenant's claims, they later ruled the regulatory agreement ambiguous, confirming that rents could be calculated based on square footage. This decision left tenants, led by Miranda Krone, feeling defeated after nearly two years of advocacy to lower rents and improve conditions in their building.
The tenants believed they were being overcharged on rent, in violation of local housing law, and sought intervention from the city's Housing Bureau.
PHB believes the evidence provided... demonstrates that Allowable Rents should be calculated based on unit square footage.
The reversal dealt a blow to Krone and her fellow tenants who have fought to improve conditions and decrease rents at Everett Station Lofts.
In a letter to tenants from PHB Director, it was mentioned that the regulatory agreement with the Lofts was considered ambiguous.
