"According to the criminal complaint, Foehner was near the driveway to the parking garage of an apartment building at 123-20 82nd Ave. just after 2 a.m. when 32-year-old Cody Gonzalez of 82nd Road, approached him, pulled out a sharp object and lunged at Foehner in an attempt to rob him. Foehner pulled out a .38 caliber Smith & Wesson revolver and fired at Gonzalez multiple times."
A 67-year-old Kew Gardens retiree was sentenced to four years in prison for possessing an arsenal of illegal assault weapons and unlicensed firearms discovered during a May 2023 investigation. The retiree pleaded guilty to criminal possession of a weapon in the second degree on Nov. 20 and was sentenced on Jan. 14. The fatal shooting occurred after a 32-year-old man allegedly approached the retiree near an apartment parking garage, pulled a sharp object and lunged at him. The retiree fired a .38 caliber Smith & Wesson revolver; the man was pronounced dead at the scene. A search of the retiree's residence recovered 26 unlicensed weapons, 13,000 rounds of ammunition, 152 large-capacity feeding devices and bulletproof vests; four firearms were determined to be assault weapons. The Queens District Attorney declined to charge the retiree for the fatal shooting.
