Curbside outdoor dining in New York City will return to year-round operation by eliminating the December-through-March restriction on roadway dining. The reform permits larger dining setups and reduces the ability of community boards to block al fresco restaurants. Application activity declined sharply after the program became seasonal, with just 400 restaurants completing the outdoor dining application process last year (about 300 roadway and 100 sidewalk) and another 2,600 operating with conditional approvals, down from a peak of 8,000 during the Covid-era emergency program. The changes aim to help small businesses survive, prevent closures and job loss, and revive expanded outdoor dining.
