In a dramatic turn, Harvey Weinstein's retrial in New York concluded with a mistrial regarding the last undecided charge from the jury. While Weinstein was found guilty of criminal sexual assault against Miriam Haley, the jury was divided on the third-degree rape charge against Jessica Mann, leading to the mistrial declaration. Mann's testimony highlighted the complexity of consent in relationships tainted by power dynamics. Following the mistrial, a new trial date remains to be set, with prosecutors prepared for a third round of litigation against Weinstein.
"Rape can happen in relationships - and in dynamics where power and manipulation control the narrative," Mann said in a statement Wednesday.
The judge then thanked the jury for their time and said the decision to declare a mistrial did not reflect on them.
Weinstein's lawyers emphasized Mann kept seeing him, accepting invitations and sending him messages.
Manhattan prosecutor Nicole Blumberg said Mann will be ready to go to trial a third time after the judge ended deliberations.
