Eric Melvin served Fat Mike with legal papers accusing him of financial malfeasance at 8 a.m. the morning after NOFX's final concert on October 6, 2024. Drummer Erik Sandin read a prepared statement at the Punk Rock Museum photo exhibit opening explaining Melvin's absence and saying Melvin directed that all communications go through his counsel. Sandin described the final show as an emotional, loving send-off and said the lawsuit letter broke his heart. Sandin also defended Fat Mike personally, asserting he is not a thief and expressing hope for a resolution. The band declined further comment. The band announced a documentary, 40 Years of Fuckin Up, set for April.
