Nurse Sandie Peggie lodged an employment tribunal after suspension for objecting to Dr Upton using the women's changing rooms at Victoria Hospital A&E on Christmas Eve 2023. The judgement published on 8 December found NHS Fife harassed Peggie, while several of her claims were dismissed. The tribunal unanimously dismissed all allegations against Dr Upton and most allegations against the Board, except four specific aspects of the harassment complaint. NHS Fife said it recognises the complexity of the process and will work with legal advisers to review the judgment and its implications for the organisation.
