Spain's parental leave system has progressed significantly since 2007, with recent expansions establishing equal leave for mothers and fathers. Despite this advancement, a discriminatory loophole remains for single parents, who are currently limited to 16 weeks of leave compared to 26 weeks available to dual-parent households. A ruling from Spain's constitutional court acknowledges this imbalance, declaring that single-parent families face similar, if not greater, needs for parental leave. The recent court petition by Silvia Pardo Moreno marks an important step towards addressing these disparities in parental leave.
Back in November, Spain's constitutional court ruled that the country's existing parental leave policy was discriminatory against children born into single-parent homes.
The policy provides babies born to two parents up to 26 weeks at home with their family while children can only have 16.
