A 55-year-old Kerry man, Billy Burns, strangled his mother while experiencing a manic or hypomanic episode related to bipolar disorder. The episode amounted to a mental illness at the time of the assault. Despite the manic or hypomanic state, Burns understood what he was doing during the killing. The State will present an argument before a trial jury that Burns is guilty of murder. There is no dispute that the accused was suffering from a mental illness when he assaulted his mother. The case will turn on criminal responsibility and whether the mental illness negates guilt.
