Suspected Gilgo Beach killer unable to appear in court, as judge sets date for rulings
"I'm not at liberty to discuss [why], he has some health issues, so that's what we're dealing with. So, at this point in time, I thought it was probably better for him to just stay at the jail."
"None of us would ever expect that when we throw something away, we discard an object, that we're then giving our whole genetic makeup. It's just not feasible."
"There were a lot of motions. I think New York State law is such with regard to DNA and the abandonment sample that we are in good standing with regard to manner in which we retained all our evidence."
Rex Heuermann, the suspected Gilgo Beach serial killer, was absent from his Tuesday court appearance due to health issues, according to his attorney Michael Brown. Heuermann has been using crutches for approximately a month. The brief hearing, lasting less than two minutes, resulted in Judge Timothy Mazzei adjourning the case until April 8. The defense filed motions to exclude DNA evidence based on privacy law concerns, specifically challenging the use of saliva from a discarded pizza crust as evidence without a warrant. The prosecution opposes these motions, arguing that New York State law permits the use of abandoned DNA samples. Heuermann faces charges for multiple murders of women found on Gilgo Beach in 2010.
