The FTC Altered the Date for "Click to Cancel" Rule Compliance

In 2023, the FTC proposed the 'click to cancel' regulation to simplify the cancellation of subscriptions like streaming services and gym memberships. This rule, known as the Negative Option Rule, has been in place since January 19 but faced a delay in enforcement from May 14 to July 14. The FTC indicated that extra time was needed to fully assess compliance challenges. They also noted potential amendments to the rule could arise from the enforcement process, indicating an ongoing evolution of subscription cancellation policies.
In a statement released on May 9, the FTC explained that it had determined the original deferral period insufficiently accounted for the complexity of compliance.
The Commission is open to amending the Rule to address any problems exposed during the enforcement experience.
