Stephen and Jennifer Powell received a £500,000 payout after a 17-storey office tower obstructed natural light to their 6th floor apartment, making reading difficult. The Powells and a neighbor sued for an injunction against the Arbor tower, part of a larger development. Although a judge refused the injunction due to potential waste and environmental damage, he acknowledged the couple's living conditions were negatively impacted. The court deemed that the couple's flat lacked sufficient light for ordinary use and enjoyment, resulting in the significant compensation awarded to them.
Mr Justice Fancourt stated that the Powells’ flat was 'substantially affected' by their light being cut off and ordered a payout of 500,000 for damages.
The judge noted that parts of the Powells’ flat had light 'insufficient for the ordinary use and enjoyment of those rooms' due to the tower.
Ludgate House Ltd contended that the tower doesn’t block enough light to validate the owners’ claims and suggested alternatives for the Powells.
