Anticipation has built unusually early in the term for a major tariffs case that remains pending at the Supreme Court. The Court has issued three hand-down sessions in January and eight signed opinions so far, none addressing tariffs. The cause of the delay is uncertain, but the delay increases the likelihood that Trump will prevail at least in part because a stay remains in place while new tariffs are imposed. Ongoing delay complicates remedial options and magnifies claimed irreparable harm, particularly given plaintiffs sought a preliminary injunction. Short unanimous opinions dominated one recent day, including multiple 9-0 decisions with very brief majority opinions.
